India becoming a hub of child prostitution: SC

New Delhi, Jan 29 (PTI) India is “becoming a hub” for largescale child prostitution rackets, the Supreme Court said today and suggested the setting up of a special investigating agency to tackle the menace. A bench of Justices Dalveer Bhandari and A K Patnaik asked Solicitor General Gopal Subramaniam to examine the idea of setting up a special investigating agency to combat child prostitution rackets and assured that courts would deny bail to those who engage children in commercial sex.”It’s happening because of abject poverty in the country. This is also because of the very high and largescale unemployment. All our cultural ethos are going down the drain. India is becoming a hub of such activities,” the apex court said while dealing with a PIL filed by an NGO Bachapan Bachao Andolan.

The apex court also wanted to know why government is not invoking section 376 IPC (rape) against those exploiting the children in such prostitution rackets. “Majority of sex workers are children. Why don’t you register 376(IPC) against them? If you do it in 10 cases, they will fall like a pack of cards. Courts will also not grant bail to them. Unfortunately, we are putting such sex workers to a lot of problem forcing them to face criminal prosecution,” the apex court said.

  1. When I worked as a Correctional Counselor for a large state corrections agency I had a child molester on my caseload who was from India on a Perm Visa. When he was convicted of molesting a female child he was sentenced to three years, got divorced, and deported. My collegues told me Indian men were statistically high on the molestation heap. Judging from my experience I’m inclined to believe that. He was a disgusting little man who not only denied his crime, but showed not even the slightest degree of remorse. Fairly typical for the hundreds of molesters I dealt with during my twenty-five year career.Glad I’m retired.

  2. The Apex court should instead formulate guidelines instructing state authorities and police to include sec.376 IPC in the FIR and chargesheet in such cases. The reason why sec.376 IPC is not added in such cases is because despite repeated request to the police at the time of filing an FIR police official refuse to do so. Therefore guidelines issued by the Apex court in respect to it would definitely make a change.

    And any one who informs about the prostitution trafficking rackets should be cept secret.
    The children involved in prostitution racket should be treated as victims not as offenders.
    A website has to be established to complain about the prostitution rackets here the anonymity of informer should be maintained
    The beat police should have a rotation.
    Pimping/ Running a brothel should be made non bailable offense having life imprisonment
